North Carolina Laws are Strict for Underage DUI/DWI

No Tolerance in Concord for Drunk Drivers Under 21

Alcohol and drugs affect a driver's reaction time and the ability to operate a vehicle safely. Those driving while intoxicated cause more than one-half of all traffic accidents. In North Carolina, a driver over 21 is intoxicated if his or her Blood Alcohol Content (BAC) is 0.08% and 0.04% if a commercial driver. For those under 21 years, the BAC is 0.00%. Law enforcement does not have to prove intoxication if the BAC is above the state's designated limit for the specific age group. A reading of a very small amount of alcohol consumed by a driver under 21 can have significant consequences. The idea is to discourage underage drinking and to make the penalties so severe that it is a deterrent. Unfortunately, testing devices and procedures for breath and blood tests can be faulty, or a police stop could have been illegal but led to a conviction that could have been successfully defended.

You May Lose Your License

You need information about your constitutional rights and the consequences if convicted of the crime. There is an automatic one-year revocation of a driver's license for a DWI under 21. An individual under 21 who purchases alcoholic beverages also faces a one-year license revocation. There are other situations involving the illegal purchase of alcohol than can bring a possible loss of driving privileges. Other ramifications can include jail, large fines, and more. If you or your child is facing DWI accusations, you need to discuss the situation with a proven defense attorney. A conviction will appear on the driver's record and it can affect employment, schooling, insurance rates, and other areas of life.
